STR Registers for CPSC Accreditation for Lead Paint; CPSC Publishes Requirements
STR has registered with the Consumer Product Safety Commission (CPSC) for recognition as an accredited third party conformity assessment body for lead paint as required under the recently enacted federal Consumer Product Safety Improvement Act of 2008 (CPSIA). The CPSC will soon post the accredited bodies on its website.
With the publication in the Federal Register of the accreditation requirements for third party conformity assessment bodies to assess conformity with 16 CFR Part 1303, the "lead in paint ban," the first CPSC rulemaking requirement under the CPSIA has been satisfied. The CPSIA sets forth in Section 102(a)(3) that the third party testing requirements shall apply to any children’s product manufactured more than 90 days after publication of the accreditation requirements. Based on the publication date of September 22, 2008, the third party testing requirement for lead paint applies to products manufactured after December 21, 2008.
The CPSC may, under limited circumstances, accept a product’s certificate of compliance based on testing performed by a laboratory on or after May 16, 2008, 90 days prior to August 14, 2008 (the date of enactment of CPSIA) but prior to the CPSC's acceptance of the laboratory's accreditation, provided that the laboratory's accreditation application is accepted by the CPSC not later than November 26, 2008.
