Phthalate Provision Not To Be Applied Retroactively

The Honorable Nancy A. Nord, Acting Chairman of the U.S. Consumer Product Safety Commission (CPSC), announced today that the phthalate provision in Section 108 of the U.S. Consumer Product Safety Improvement Act of 2008 (CPSIA) would not be applied retroactively to existing inventory. Therefore, per CPSIA, only children’s toys and child care articles that are manufactured on or after February 10, 2009 would be required to comply with the prohibition on phthalates.

Speaking at the 4th European Meeting and Training Symposium in Brussels, Belgium, Acting Chairman Nord spoke about the major changes that have taken place within the consumer product safety industry over the past year and about future phases of product safety, including implementation of the CPSIA. A written statement regarding the CPSC's interpretation of the phthalate provision is expected to be published later today.
